The Implications of Russia’s Invasion of Ukraine for International Law and Security

Framing Questions:

  • Does the invasion show that Vladimir Putin is a strategic or opportunistic leader? What aims do Russia, Ukraine, and the West have in the war, and how have they evolved over the last three months?
  • Why did most Western analysts underestimate Ukraine and overestimate Russia prior to the invasion? Has the war revealed Russia’s recent military modernization to be unsuccessful?
  • How effective has Western security assistance been in improving Ukraine’s ability to resist Russia’s military campaign? What defense equipment has made the biggest difference? What role has intelligence sharing played on the battlefield? How has the West managed escalation risks amid the hostilities?
  • What implications does the war have for international law, particularly the law on the use of force, international humanitarian law, international criminal law, and international human rights law?
  • How might the weakening of Russian forces impact Eurasian security? How might diminished Russian military presence in the South Caucasus, Central Asia, and Syria create power vacuums, and who might fill them? What might the future hold for Russian forces in Moldova and the Black Sea?
  • How might the entry of Sweden and Finland into NATO impact European security? How has the war changed the prospects of Ukraine and Georgia joining NATO someday?
  • How are allegations of war crimes, genocide, crimes against humanity, and the crime of aggression being investigated by Ukraine, the International Criminal Court, and other countries and international bodies? Who should be held accountable for the alleged atrocities? What might the emerging war crimes prosecutions in Ukraine achieve?
